Platform terms and conditions

These Terms of Use govern your access to and use of UNIQUESAVIOR, operated by Unique Sunday Enterprise ("we", "us", "our"). By creating an account, placing an order, registering for an event, or otherwise using the platform, you agree to be bound by these terms.

This is a draft operational Terms of Use prepared for implementation purposes. It should be reviewed by qualified legal counsel before production launch.

You must provide accurate, current information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be legally capable of entering into a binding contract under Malaysian law to register an account or place an order. We may suspend or terminate accounts that provide false information, violate these terms, or engage in fraudulent or abusive activity.

Products listed on UNIQUESAVIOR are limited-edition or collectible items sold in fixed quantities. Once a product's initial stock sells out, further ownership transfers occur through the resell marketplace described below, subject to admin fulfilment from reserve stock.

All prices are displayed in Malaysian Ringgit (MYR) and are inclusive or exclusive of taxes as stated at checkout. For certain products, the admin may configure a price increment so that the listed price rises as stock sells down (for example, per unit sold or per stock tier). The price you pay is the price displayed at the time your order is placed and confirmed.

We reserve the right to correct pricing errors, limit order quantities per customer, and withdraw or amend product listings at any time before an order is confirmed.

Orders are processed once payment has been successfully authorized. We accept payment through Stripe and Fiuu, supporting major credit and debit cards, Touch 'n Go eWallet, DuitNow QR, and Malaysian online banking (FPX), subject to availability at checkout.

All payments are processed by our payment gateway partners; we do not store your full card or banking credentials. You are responsible for ensuring your payment details are accurate and that you are authorized to use the payment method provided.

An order is only confirmed once payment has cleared and you have received an order confirmation. We reserve the right to cancel or refuse any order suspected of fraud, error, or abuse, subject to our Return / Refund Policy.

Each qualifying purchase is associated with a digital ownership certificate recorded on the platform, evidencing your ownership of the corresponding product unit. Certificates are digital records within your account and are not issued as physical documents.

Certificate holders may list their ownership for resale on the resell marketplace once a product has sold out. Resale listings are subject to admin review and are fulfilled from reserve stock held by Unique Sunday Enterprise. We may set resale price limits, platform fees, and other conditions on resale transactions, which will be disclosed at the time of listing.

Transfer of a certificate through the resell marketplace transfers the associated ownership record to the new buyer upon completion of the transaction. We are not a party to, and do not guarantee the value, condition, or authenticity representations made in, any private arrangement outside the platform's resell marketplace.

We may organize or promote beach cleanup and related community events. Registration for an event through the platform constitutes your agreement to attend responsibly, follow the instructions of event organizers and safety personnel, and assume the personal risks inherent in outdoor volunteer activities.

Event capacity, schedules, and locations are subject to change or cancellation. Where an event is cancelled by the organizer, refunds (where a registration fee applies) will be handled in accordance with our Return / Refund Policy.

Certain products carry a unique QR code used to record ownership trail events, verify authenticity, and support fraud prevention and provenance analytics. Scanning a product's QR code may log scan metadata such as timestamp, approximate location, and device information as described in our Privacy Policy.

You should not tamper with, duplicate, or misuse QR codes assigned to products, as this may compromise ownership verification for you and other users.

You agree not to: use the platform for any unlawful purpose; attempt to circumvent security, pricing, or stock-allocation mechanisms; create multiple accounts to evade purchase limits; upload false or misleading information; interfere with the platform's operation; or resell products or certificates outside the resell marketplace in a manner that misrepresents their source or authenticity.

We reserve the right to suspend or terminate access, cancel orders, and pursue any available legal remedies against users who engage in prohibited conduct.

All content on UNIQUESAVIOR, including product designs, photography, logos, the UNIQUESAVIOR brand, certificate designs, and site software, is owned by or licensed to Unique Sunday Enterprise and is protected by applicable intellectual property laws.

Your purchase of a product and its associated certificate grants you ownership of the physical or collectible item as described in the listing; it does not grant you any license to reproduce, distribute, or commercially exploit our brand assets, photography, or platform content, except as expressly permitted.

To the fullest extent permitted by law, Unique Sunday Enterprise shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, participation in events, or reliance on resell marketplace transactions between users.

Our aggregate liability for any claim arising from an order shall not exceed the amount you paid for the relevant product or service. Nothing in these terms excludes or limits liability that cannot be excluded or limited under Malaysian law.

We may update these Terms of Use from time to time to reflect changes to our platform, services, or legal requirements. Material changes will be notified through the platform or by email, and continued use after such changes constitutes acceptance of the updated terms.

These Terms of Use are governed by the laws of Malaysia. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
